CONDITIONAL GUARANTEE
AS A SUFFICIENT INDUCEMENT TO BUYER AND IN EXCHANGE FOR THE PROMISES OF BREEDER,
BUYER AGREES AND ACKNOWLEDGES:
- To have the puppy examined within (3) business days of taking possession of the puppy by a licensed and reputable *veterinarian to validate this guarantee. If the health of the puppy is found to be at risk due to a *debilitating congenital defect (existing at birth), the buyer shall notify the breeder and provide a written statement from a licensed veterinarian describing the puppy’s condition. The puppy shall be returned, at the Buyer’s expense, along with the papers, to the breeder within three days of the examination. Breeder will replace puppy or refund money at Breeder’s sole election and discretion, provided puppy is in the same condition mentally and physically as when originally purchased. This does not include worms, fleas, mites, cocci, Giardia, or any other parasites, as they are common in dogs and puppies.
- The puppy is not being purchased for resale, breeding purposes, and will never be sold to a pet shop, puppy mill, or agent of the same.
- Buyer is not to register the puppy under any other Pet Registry, other than the American Kennel Club. (AKC)
- To register the microchip within seven business days of receiving the puppy.
- To provide all annual vet exams, to continue all required vaccine shots as recommended by their vet, and proper vet care. The puppy must receive all the necessary vaccinations and yearly boosters. Failure to comply with and provide documentation of these requirements voids all guarantees.
- To provide adequate housing away from the elements. Buyer will have a fenced yard or kennel if the dog will be housed outside. The dog will NEVER be left on a chain. The Buyer will groom, train, and care for this dog in the manner consistent with high-quality animal husbandry.
- The value of the pet for the purpose of this guarantee is solely the original purchase price of the pet. It does not include any additional prices declared by the Buyer, such as, but not limited to, transportation, training, or the value of the show dog.
- The Breeder highly recommends that the Buyer provide basic obedience training with their puppy within the first year of owning their dog.
- The Buyer allows the Breeder to use any pictures of the dog that are sent to them or posted on social media for the purposes of sharing on the website, newsletter, and the Breeder’s social media accounts.
- Time is of the essence. The laws of the State of Arkansas shall govern this agreement. If, for any reason, litigation should occur, the venue shall lie in Scott County, Arkansas. The breeder will not be responsible for any costs associated with this process.
- Failure to comply strictly with all of the foregoing requirements will result in termination and revocation of this Guarantee in the discretion of the Breeder. Further limitations are set forth below.
SPAY AND NEUTER AGREEMENT
Spaying/neutering/sterilization by a licensed, reputable veterinarian is required on the above puppy within 30 months of age by age 2 ½ years old, but not before 12 months. Studies have found that spayed or neutered dogs are more likely to be overweight or obese.
Dogs fixed before 6 months have a much higher rate of orthopedic injuries, and keeping dogs lean did not prevent those injuries.
*Spaying or neutering before 18 months nulls and voids the health guarantee.
LIMITATIONS OF GUARANTEE:
This guarantee is non-transferable and not subject to assignment. This guarantee is an exclusive guarantee between Breeder and Buyer. The puppy must be in good physical condition. No replacement will be given if the dog has been bred. A licensed, reputable veterinarian must perform all laboratory verifications. The Buyer is responsible for all transportation costs to and from the Breeder. The breeder is not responsible for any veterinarian expenses accumulated on a returned or replaced dog or puppy. The breeder’s sole expense and thus the limit on the Buyer’s damages shall be the price paid by the Buyer to the Breeder for the puppy cost.
THE FOLLOWING 1-7 WILL VOID ALL GUARANTEES IN THE DISCRETION OF THE BREEDER:
- Buyer permitting the dog to be underfed or overfed at any time.
- Underfed: Ribs are highly visible.
- Ideal Body Condition: Can feel the outline of ribs. A dog has a waist when viewed from above. Belly is tucked when viewed from the side.
- Overfed: Dog has no waist when viewed from above. The belly is rounded when viewed from the side. (Please take into consideration how thick a coat your dog has when viewing)
- Evidence of neglect or abuse.
- Previous related trauma (broken bones, related injuries, etc.)
- The dog has been bred.
- Feeding this dog anything other than a premium quality dog food.
- Feeding this dog any dog food with wheat, corn, soy, or by-products.
- Evidence of Strenuous Exercise – for example: No treadmill, no jogging, no extensive standing on the back of legs, or excessive tennis ball chasing and retrieving should be done, especially on slippery floors.
AS A SUFFICIENT INDUCEMENT TO THE BREEDER AND IN EXCHANGE FOR THE PROMISES OF THE BUYER,
BREEDER AGREES AND ACKNOWLEDGES:
- Breeder guarantees that the puppy has had proper care to date and has been checked by a veterinarian.
- Puppy has received age-appropriate immunizations and deworming. Shot records will be furnished at the time of purchase.
- Puppy has been microchipped and registration paid for
- The breeder guarantees all possible steps have been taken with the sire/dam selection and breeding practices to prevent hereditary issues. No breeder can state that any given puppy will be completely free of a genetic defect, but only that all measures to reduce the probability have been taken.
- Breeder is not responsible if the puppy contracts a communicable disease after leaving the breeder’s possession.
- Breeder guarantees puppy against any congenital defect causing death or necessitating euthanasia until one year of age.
If a congenital defect is identified within the warranty period, the buyer has the option to obtain a replacement puppy from the Breeder from the next available litter.
- The original puppy need not be returned, but proper documentation must be provided of the congenital defect.
This warranty does not include viral illnesses, infections, improper bites, stress-related illnesses, hernias, hypoglycemia, cancer or endocrine disorders. It also does not include any illness due to the ingestion of foreign objects, food, chemicals, or physical injury.
No warranties or guarantees, expressed or implied, are made under this contract except as stated.
- Breeder provides FREE 30-day health insurance that is included in your packet of information that MUST be activated within 24 hours of going home with your puppy. Failure to activate the free Trupanion health insurance or another insurance of your choice on the day of ownership transfer will void this guarantee.
It is understood that the Breeder does NOT, under any circumstances, accept responsibility for any veterinarian and/or health care expense.
- Breeder offers a one-year hip guarantee on any puppy found to have moderate or severely affected hip dysplasia. For this provision, the puppy must have a new X-ray by a reputable veterinarian to confirm the diagnosis, and an official OFA preliminary consultation must document it.
- Upon receipt of a letter to the Breeder from a reputable veterinarian stating that, in his/her opinion, this condition is congenital, the puppy will be replaced by a puppy of equal value (minus any training or delivery expense) at the Breeder’s convenience. We reserve the right to have a second opinion from our veterinarian. We also reserve the right to acquire a DNA sample from the puppy to determine the dog or puppy as one of our lineages.
To be covered by this guarantee, the following conditions are applicable and are preconditions:
- Puppy must be owned by the original owner named in this agreement.
- In the case of the sudden death of a puppy, the breeder must receive a written notice of the puppy’s death from the owner’s vet, along with a necropsy report indicating the cause of death.
- Breeder does not guarantee color, size, championship, or temperament of any puppy.
*For purposes of this Agreement:
*A reputable veterinarian is duly licensed by the state in which he practices and maintains an active, full-time private practice of which the care of dogs owned as pets is the most significant element of his practice.
*Debilitating congenital defects are defined as those present at birth that are life-threatening.

Buyer acknowledges and affirms that Breeder has recommended, for the benefit of the puppy, Life’s Abundance and Wellness Food Supplements; however, the use of these products is merely a recommendation from Breeder, not a guarantee of their effectiveness or efficiency.

I have read and understand the above conditions and limited guarantees and information regarding this puppy and agree to and acknowledge all of its terms and conditions. The Seller hereby accepts a non-refundable deposit of $500.00 (to be given/mailed with contract to Seller) toward the purchase of the puppy identified above.
The Seller, upon receipt of the $500 deposit mentioned above, acknowledges that the Buyer is purchasing a puppy with LIMITED registration. Limited Registration means this dog cannot be bred and is intended as a companion dog only. This deposit is non-refundable, except if not enough puppies are whelped to supply the Buyer, in which case any applicable fees will be deducted from it.
The full purchase price is $____.00. This amount does not include delivery and is due in full before the Seller delivers the puppy to the Buyer.
